(Chapter 1) General
Article [-] In order to regulate the business activities of motor vehicle maintenance, maintain the order of the motor vehicle maintenance market, protect the legitimate rights and interests of all parties involved in motor vehicle maintenance, ensure the safety of motor vehicle operation, protect the environment, save energy, and promote the healthy development of the motor vehicle maintenance industry, These regulations are formulated in accordance with the "Regulations of the People's Republic of China on Road Transport" and relevant laws and administrative regulations.

Article [-] Whoever engages in motor vehicle maintenance business shall abide by these Provisions.

The term “motor vehicle maintenance operation” as mentioned in these regulations refers to the maintenance, repair, repair and rescue and other related business activities carried out with the task of maintaining or restoring the technical condition and normal functions of motor vehicles and prolonging the service life of motor vehicles.

Article [-] Motor vehicle maintenance operators shall operate in accordance with the law, be honest and credible, compete fairly, and provide high-quality services.

Article [-] The management of motor vehicle maintenance shall be fair, impartial, open and convenient for the people.

Article [-] No unit or individual may block or monopolize the motor vehicle maintenance market.

Encourage motor vehicle maintenance enterprises to implement intensification, specialization, and chain operation, and promote the rational division of labor and coordinated development of the motor vehicle maintenance industry.

Encourage the promotion and application of environmental protection, energy saving, non-disassembly detection and fault diagnosis technologies for motor vehicle maintenance, promote the construction of industry informatization and network construction of rescue and maintenance services, improve the overall quality of the motor vehicle maintenance industry, and meet social needs.

Article [-] The Ministry of Communications is in charge of the management of motor vehicle maintenance throughout the country.

The competent transportation departments of the local people's governments at or above the county level are responsible for organizing and leading the management of motor vehicle maintenance in their respective administrative regions.

Road transport management agencies at or above the county level are responsible for implementing the management of motor vehicle maintenance within their respective administrative regions.

(Chapter 2) Business License

Article [-] The operation of motor vehicle repair and maintenance shall be licensed according to the types of repair models, service capabilities and business items.

The motor vehicle maintenance business is divided into four categories according to the maintenance objects: automobile maintenance business, dangerous goods transport vehicle maintenance business, motorcycle maintenance business and other motor vehicle maintenance business.

Automobile repair business and other motor vehicle repair business are divided into Class I repair business, Class II repair business and Class III repair business according to business items and service capabilities.

The motorcycle maintenance business is divided into the first-class maintenance business and the second-class maintenance business according to the business items and service capabilities.

Article [-] Those who have obtained the business licenses for Class I automobile repair business and Class I other motor vehicle repair business can engage in complete vehicle repair, assembly repair, complete vehicle maintenance, minor repair, maintenance rescue, special repair and maintenance completion inspection of corresponding models. Work; those who have obtained the license for the second-class automobile maintenance business and the second-class other motor vehicle maintenance business can engage in the corresponding vehicle repair, assembly repair, complete vehicle maintenance, minor repair, maintenance rescue and special repair work; Those licensed for the business of automobile maintenance and the business of maintenance of the three types of other motor vehicles may engage in engine, body, electrical system, automatic transmission maintenance, body cleaning and maintenance, painting, tire dynamic balancing and repair, four-wheel alignment inspection and adjustment, supply Oil system maintenance and oil product replacement, fuel injection pump and fuel injector maintenance, crankshaft grinding, cylinder boring and grinding, radiator (water tank), air conditioning maintenance, vehicle decoration (tarpaulin, seat cushion and interior decoration), vehicle glass installation, etc. Work.

Article [-] Those who have obtained a business license for the maintenance of Class I motorcycles may engage in motorcycle repairs, assembly repairs, vehicle maintenance, minor repairs, special repairs, and completion inspection; those who have obtained business licenses for the maintenance of Class II motorcycles, Can be engaged in motorcycle maintenance, minor repairs and special repairs.

Article [-] Those who have obtained the business license for maintenance of vehicles transporting dangerous goods may engage in the business of maintenance of Class I automobiles in addition to the business of maintenance of vehicles transporting dangerous goods.

Article No.11 Those who apply for engaging in automobile maintenance business or other motor vehicle maintenance business shall meet the following conditions:

(1) Having maintenance vehicle parking lots and production workshops suitable for its business operations.There should be a written lease contract for the rented venue, and the lease term should not be less than one year.The area of ​​the parking lot and the production workshop shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of the Automobile Maintenance Industry KGB/D 16739).

(16739) It has equipment and facilities suitable for its business operations.The measuring equipment equipped shall meet the requirements of the relevant national technical standards and shall pass the inspection of the statutory inspection institution.The specific requirements for equipment and facilities engaged in automobile maintenance business shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of Automobile Maintenance Industry" (GB/T16739); for the specific requirements for equipment and facilities engaged in other motor vehicle maintenance business, refer to the national The standard "Conditions for the Opening of Automobile Maintenance Industry" (GB/T[-]) shall be implemented, but the facilities and equipment shall be compatible with the vehicle types to be maintained.

([-]) Necessary technical personnel:
1. Those engaged in Class I and Class II maintenance services shall be equipped with at least one technical person in charge and quality inspection personnel.Technical personnel in charge shall be familiar with the maintenance business of automobiles or other motor vehicles, and master the maintenance of automobiles or other motor vehicles and relevant policies, regulations and technical specifications; Familiar with the related technologies of motor vehicle maintenance fault diagnosis and quality inspection, familiar with the charging standards of automobile or other motor vehicle maintenance services and related policies, regulations and technical specifications.1% of the total number of technical responsible personnel and quality inspection personnel should pass the national unified examination.

2. Those engaged in Class I and Class II maintenance businesses shall be equipped with at least one maintenance technician engaged in machine repair, electrical appliances, sheet metal, and painting; the maintenance technicians engaged in machine repair, electrical appliances, sheet metal, and painting shall be familiar with the The maintenance techniques and operating specifications of the type of work, and understand the maintenance of automobiles or other motor vehicles and related policies and regulations.1% of the total number of maintenance technicians for machine repair, electrical appliances, sheet metal, and painting should pass the national unified examination.

3. Those engaged in the three types of maintenance business shall be equipped with corresponding maintenance technicians for machine repair, electrical appliances, sheet metal, and painting according to their business items; those engaged in engine maintenance, body maintenance, electrical system maintenance, and automatic transmission maintenance shall also be equipped with Technical responsible personnel and quality inspection personnel.40% of the total number of technicians in charge, quality inspectors, and maintenance technicians for machine repair, electrical appliances, sheet metal, and painting shall pass the unified national examination.

(16739) Having a sound maintenance management system.Including quality management system, safety production management system, vehicle maintenance file management system, personnel training system, equipment management system and spare parts management system.The specific requirements shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of Automobile Maintenance Industry KGB/T[-]).

(16739) There are necessary environmental protection measures.The specific requirements shall be implemented in accordance with the relevant provisions of the national standard (KGB/D [-], the opening conditions of the automobile maintenance industry).

Article No.12 An automobile maintenance business operator engaged in the maintenance of vehicles transporting dangerous goods shall meet the following conditions in addition to the conditions for opening a maintenance business of the type of automobile maintenance operation:

([-]) There are special maintenance workshops, equipment and facilities suitable for its operation content, and clear indicative signs are set up;
([-]) Having a complete contingency plan for emergencies, which includes reporting procedures, emergency command, and disposal measures;

([-]) Having corresponding safety management personnel;

([-]) There are complete safety operating procedures.

The maintenance of dangerous goods transport vehicles mentioned in these regulations refers to the maintenance of motor vehicles for transporting flammable, explosive, corrosive, radioactive, highly toxic and other goods, and does not include the maintenance of tanks of dangerous goods transport vehicles.

Article No.13 Those who apply for motorcycle maintenance business shall meet the following conditions:
(1) It has a motorcycle maintenance parking lot and a production plant suitable for its business operations.There should be a written lease contract for the rented venue, and the lease period should not be less than 18189 year.The area of ​​the parking lot and the production plant shall be in accordance with the provisions of the relevant provisions of the national standard (KGB/T[-], the opening conditions for the motorcycle maintenance industry).

(18189) It has equipment and facilities suitable for its business operations.The measuring equipment equipped should meet the requirements of the relevant national technical standards and pass the verification of the statutory verification institution.The specific requirements shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of Motorcycle Maintenance Industry (GB/D [-]).

([-]) Necessary technical personnel:
1. Those engaged in Class I maintenance business shall have at least one quality inspector.Quality inspectors should be familiar with various types of motorcycle maintenance and testing operation specifications, master the relevant technologies of motorcycle maintenance fault diagnosis and quality inspection, and be familiar with the charging standards for motorcycle maintenance services and relevant policies, regulations and technical specifications.1% of the total number of quality inspectors shall pass the national unified examination.

2. According to their business operations, they are equipped with corresponding maintenance technicians for machine repair, electrical appliances, sheet metal, and painting.Mechanical repair, electrical appliances, sheet metal, and painting maintenance technicians should be familiar with the maintenance techniques and operating specifications of the type of work they are engaged in, and understand motorcycle maintenance and related policies and regulations.30% of the total number of maintenance technicians for machine repair, electrical appliances, sheet metal, and painting should pass the national unified examination.

(18189) Having a sound maintenance management system.Including quality management system, safety production management system, motorcycle maintenance file management system, personnel training system, equipment management system and spare parts management system.The specific requirements shall be implemented in accordance with the provisions of the relevant provisions of the national standard (KGB/D [-], the opening conditions of the motorcycle maintenance industry).

(18189) There are necessary environmental protection measures.The specific requirements shall be implemented in accordance with the provisions of the relevant provisions of the national standard (KGB/D [-], the opening conditions of the motorcycle maintenance industry).

Article No.14 To apply for motor vehicle maintenance business, an application shall be submitted to the county-level road transport management agency where the applicant is located, and the following materials shall be submitted:
([-]) "Application for Traffic Administrative Permit"

([-]) Photocopies of business site, parking lot area materials, land use right and property right certificate;

([-]) Technical personnel summary table and corresponding professional qualification certificates;
([-]) Photocopies of inspection certificates for maintenance and testing equipment and measurement equipment;

(11) In accordance with the maintenance and operation of automobiles, other motor vehicles, dangerous goods transport vehicles, and motorcycles, provide other relevant materials according to the conditions stipulated in Articles No. 12, No. 13, and No. [-] of these regulations.

Article No.15 The road transport management agency shall implement the administrative license for motor vehicle maintenance business in accordance with the procedures specified in the "Regulations of the People's Republic of China on Road Transport" and "Regulations on the Implementation Procedures of Traffic Administrative Licensing".

Article No. 16 Where the road transport management agency accepts an application for motor vehicle repair and maintenance business, it shall make a decision on whether to approve or not within 15 days from the date of accepting the application.If the statutory conditions are met, the road transport management agency shall make a decision to approve the administrative license, issue a "Decision on Traffic Administrative License" to the applicant, and issue a motor vehicle maintenance business license to the licensee within 10 days, specifying the licensed items; If there are conditions, the road transport management agency shall make a decision not to grant permission, issue a "Decision Not to Grant Traffic Administrative Licensing" to the applicant, explain the reasons, and inform the applicant of the right to apply for administrative reconsideration or file an administrative lawsuit according to law.

A motor vehicle maintenance operator shall go through the relevant registration procedures with the industrial and commercial administrative authority with the motor vehicle maintenance business license.

Article No.17 To apply for a motor vehicle maintenance chain operation service outlet, the headquarters of the motor vehicle maintenance chain operation enterprise may file an application with the county-level road transport management agency where the chain operation service outlet is located, submit the following materials, and be responsible for the authenticity of the materials. responsibility:

([-]) A photocopy of the motor vehicle maintenance business license of the headquarters of the motor vehicle maintenance chain operation enterprise;

([-]) A copy of the chain operation agreement;
([-]) Operating standards and management manuals for chain operations;

([-]) A letter of commitment stating that the chain operation service outlets meet the corresponding opening conditions for motor vehicle maintenance operations.

After checking that the application materials are complete and valid, the road transport management agency shall grant the permit on the spot or within 5 days, and issue the corresponding permit.The business licensing items of the chain operation service outlets shall be within the scope of the licensing items of the headquarters of the motor vehicle maintenance chain operation enterprise.

No.18 The valid period system shall be implemented for the motor vehicle maintenance business license.The validity period of certificates for engaging in Class I and Class II automobile maintenance business and Class I motorcycle maintenance business is 6 years; the validity period of certificates for engaging in Class III automobile maintenance business, Class II motorcycle maintenance business and other motor vehicle maintenance business is 3 years.

Motor vehicle maintenance business licenses are uniformly printed and numbered by road transport management agencies of provinces, autonomous regions, and municipalities directly under the Central Government, and county-level road transport management agencies issue and manage them in accordance with regulations.

Article No.19 The motor vehicle maintenance operator shall go through the license renewal procedures at the road transport management agency that made the original license decision 30 days before the license expires.

Article No.20 If a motor vehicle maintenance operator changes the licensing items, it shall handle the administrative licensing matters in accordance with the relevant provisions of this chapter.

If a motor vehicle maintenance operator changes its name, legal representative, address, etc., it shall file a record with the road transport management agency that made the original licensing decision.

If a motor vehicle maintenance operator needs to terminate its operation, it shall notify the road transport management agency that made the original licensing decision to go through the cancellation procedures 30 days before the termination of operation.

(Chapter 3) Maintenance Operation

Article No.20 Motor vehicle maintenance operators shall carry out maintenance services in accordance with the approved administrative licensing items.

No.20 Article [-] The motor vehicle maintenance operator shall hang the motor vehicle maintenance business license and the "Motor Vehicle Maintenance Sign" in a conspicuous position of the business place.

The "Motor Vehicle Maintenance Sign Board" is made by the motor vehicle maintenance operators themselves in accordance with the uniform style and requirements.

No.20 Three motor vehicle repair operators shall not modify motor vehicles without authorization, shall not undertake repairs on scrapped motor vehicles, and shall not assemble motor vehicles with accessories.

If the requesting repair party wants to change the color of the motor vehicle body, replace the engine, body and frame, it shall go through the relevant procedures in accordance with the relevant laws and regulations, and the motor vehicle maintenance operator may undertake the repair after checking the relevant procedures.
